Terms of Service for InstaRecipe

1. Acceptance of Terms

By downloading, installing, or using the InstaRecipe application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you must not use the App.

2. Eligibility

InstaRecipe is available to individuals who are at least 13 years old. By using the App, you represent and warrant that you meet this eligibility requirement. If you are under the age of 13, you may not use the App.

3. License Grant

Subject to your compliance with these Terms, InstaRecipe grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App solely for your personal, non-commercial use. InstaRecipe reserves all rights not expressly granted to you under these Terms.

4. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

  • Reverse engineer, decompile, or disassemble the App, except to the extent that such activity is expressly permitted by applicable law;
  • Use the App in any manner that could interfere with, disrupt, or negatively affect other users from fully enjoying the App or that could damage, disable, overburden, or impair the functioning of the App;
  • Attempt to gain unauthorized access to any portion of the App, other users’ accounts, or any related networks or systems;
  • Use any robot, spider, crawler, scraper, or other automated means to access the App or extract data;
  • Engage in any activity that violates any applicable law, regulation, or third-party rights.

5. User Content

InstaRecipe allows you to share and store recipes derived from social media platforms. You retain all rights to the content you submit, store, or share through the App (“User Content”). However, by using the App, you grant InstaRecipe a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display User Content for the purpose of operating and improving the App.

You represent and warrant that you own or have the necessary rights to all User Content you submit, and that your User Content does not violate any third-party rights or applicable laws.

6. Data Collection and Privacy

InstaRecipe does not collect any personal information from users. All data related to recipes is stored locally on your device. Please refer to our Privacy Policy for more information about our data practices.

7. Third-Party Services

InstaRecipe may integrate with or make use of third-party services, including but not limited to Firebase, Mixpanel, and GrowthBooks. Your use of these third-party services is subject to their respective terms and conditions. InstaRecipe is not responsible for the actions, omissions, or policies of any third-party service.

8. Intellectual Property Rights

InstaRecipe and its associated logos, trademarks, and content are the property of InstaRecipe and/or its licensors. Except as expressly provided in these Terms, no rights, title, or interest in or to the App or any content therein are transferred to you. All rights not expressly granted are reserved by InstaRecipe.

9. Termination

InstaRecipe reserves the right to terminate or suspend your access to the App at any time, with or without notice, for any reason, including if you violate these Terms. Upon termination, your license to use the App will immediately cease, and you must delete all copies of the App from your devices.

10. Disclaimer of Warranties

The App is provided on an “as-is” and “as-available” basis. InstaRecipe makes no warranties or representations, express or implied, regarding the App, including but not limited to the accuracy, reliability, completeness, or timeliness of the App. InstaRecipe disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, InstaRecipe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the App, even if InstaRecipe has been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless InstaRecipe and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in [Your County], [Your State], and you hereby consent to the personal jurisdiction and venue therein.

14. Changes to These Terms

InstaRecipe reserves the right to modify these Terms at any time. If we make material changes, we will provide notice through the App or by other means. Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms.
